1. INTRODUCTION

These Terms & Conditions ("Terms") govern your access to and use of the QuickMenu ZM website, digital menu platform, QR menu services, customer support services, and related products and services ("Service").

QuickMenu ZM ("QuickMenu ZM", "we", "us", or "our") provides digital menu solutions primarily for restaurants, cafés, lounges, bars, hotels, food businesses, and other hospitality establishments in Zambia.

By purchasing, registering for, accessing, or using our Service, you agree to these Terms. If you do not agree with these Terms, you should not use or purchase the Service.

If you are using QuickMenu ZM on behalf of a restaurant, company, partnership, or other business, you confirm that you have authority to accept these Terms on behalf of that business.

2. DESCRIPTION OF THE SERVICE

QuickMenu ZM provides digital menu services that may include:

Mobile-friendly digital menus.

QR codes for accessing digital menus.

Branded menu designs.

Menu item descriptions, prices and photographs.

Menu updates.

Table QR codes or stickers, where included in the selected plan.

WhatsApp-based customer support.

Social media or business links, where included in the selected plan.

Menu hosting and related technical services.

Other digital hospitality services introduced by QuickMenu ZM from time to time.

The exact features available to you depend on the subscription plan purchased.

Current plans and features may change from time to time. The applicable plan and pricing at the time of purchase will apply to your subscription.

3. ACCOUNT AND CUSTOMER INFORMATION

Where an account or customer profile is required, you agree to provide accurate and up-to-date information.

You are responsible for:

Providing correct business information.

Providing accurate menu items, descriptions and prices.

Providing appropriate photographs and branding materials.

Informing QuickMenu ZM of any changes to your business information.

Keeping any account credentials confidential.

Ensuring that information submitted to QuickMenu ZM is lawful and accurate.

QuickMenu ZM is not responsible for errors resulting from incorrect or outdated information supplied by the customer.

4. CUSTOMER CONTENT

You retain ownership of the content you provide to QuickMenu ZM, including:

Business names.

Logos.

Food and beverage photographs.

Menu descriptions.

Prices.

Promotional information.

Contact details.

Social media links.

Other business information.

By submitting content to QuickMenu ZM, you grant us a limited, non-exclusive licence to use, reproduce, modify, format, display and publish that content solely for the purpose of providing and operating the Service.

You confirm that you have the necessary rights and permissions to use all content submitted to us.

5. MENU INFORMATION AND ACCURACY

The restaurant or business remains responsible for the accuracy of its menu.

QuickMenu ZM is not responsible for:

Incorrect prices.

Incorrect food descriptions.

Incorrect photographs.

Incorrect availability information.

Incorrect opening hours.

Allergens or nutritional information supplied by the business.

Products that are unavailable.

Changes to menus that have not been communicated to us.

Businesses should review their digital menu regularly and notify QuickMenu ZM of required changes.

6. MENU UPDATES

Depending on the selected subscription plan, customers may receive a specified number of menu updates or unlimited updates.

The current website plans include different update allowances depending on the subscription selected.

QuickMenu ZM will make reasonable efforts to process requested updates within the applicable service timeframe.

Where updates are submitted through WhatsApp, customers should provide clear and complete information.

QuickMenu ZM is not responsible for delays caused by:

Incomplete information.

Incorrect information.

Poor-quality images.

Delayed customer responses.

Technical problems outside our reasonable control.

Third-party service interruptions.

7. QR CODES

QuickMenu ZM may provide customers with custom QR codes associated with their digital menu.

Customers are responsible for displaying QR codes appropriately at their premises.

QR codes must not be:

Altered in a way that prevents scanning.

Used for unlawful purposes.

Redirected or tampered with without authorization.

Reproduced in a misleading manner.

QuickMenu ZM may replace or regenerate QR codes where reasonably necessary.

8. SUBSCRIPTIONS AND PAYMENT

QuickMenu ZM operates subscription-based plans.

The available plans, pricing and included features are displayed on the QuickMenu ZM website and may change from time to time.

The customer agrees to pay the applicable subscription fee before the Service is activated or renewed, unless otherwise agreed in writing.

Subscription fees are generally quoted in Zambian Kwacha (ZMW/K).

The customer is responsible for providing accurate payment information and completing payment through the payment method made available by QuickMenu ZM.

9. SUBSCRIPTION PERIOD

Your subscription remains active for the period purchased.

Subscription periods may include quarterly, half-yearly, yearly, or other plans introduced by QuickMenu ZM.

The Service may be suspended or deactivated when the subscription expires or payment is not received.

Where a subscription expires, QuickMenu ZM may temporarily retain the customer's menu data for a reasonable period before permanent deletion.

10. CANCELLATION AND REFUNDS

Customers may request cancellation of their subscription by contacting QuickMenu ZM.

Unless otherwise agreed in writing, subscription fees already paid are non-refundable, except where a refund is required by applicable law or QuickMenu ZM expressly approves a refund.

If QuickMenu ZM is unable to provide the purchased Service due to circumstances within its reasonable control, we may, at our discretion, provide an appropriate remedy, extension, credit, or refund.

11. SERVICE AVAILABILITY

We aim to provide reliable and continuous access to the Service.

However, QuickMenu ZM does not guarantee that the Service will always be:

Available without interruption.

Free from technical errors.

Available at all times.

Compatible with every device, browser, network or operating system.

The Service may occasionally be unavailable because of:

Maintenance.

Software updates.

Hosting problems.

Internet or telecommunications failures.

Cybersecurity incidents.

Third-party service failures.

Force majeure events.

We will make reasonable efforts to restore the Service as soon as reasonably possible.

12. THIRD-PARTY SERVICES

QuickMenu ZM may rely on third-party services such as:

Web hosting providers.

Internet infrastructure providers.

WhatsApp.

Payment providers.

Domain and DNS providers.

Analytics services.

Cloud services.

Other technology providers.

QuickMenu ZM is not responsible for outages, failures, changes, restrictions or interruptions caused by third-party providers outside our reasonable control.

13. ACCEPTABLE USE

You agree not to use QuickMenu ZM to:

Publish unlawful, fraudulent or misleading content.

Publish content that infringes another person's intellectual property rights.

Upload malware, viruses or malicious code.

Attempt to gain unauthorized access to the platform.

Attempt to interfere with the operation of the Service.

Reverse engineer or copy the platform or its software.

Scrape or systematically extract platform data without written permission.

Use the Service for fraudulent activities.

Impersonate another person or business.

Use the Service for any purpose that violates applicable laws in Zambia.

QuickMenu ZM reserves the right to suspend or terminate accounts that violate these Terms.

14. INTELLECTUAL PROPERTY

The QuickMenu ZM name, logo, website design, software, platform, graphics, layouts, documentation, trademarks, and other proprietary materials belong to QuickMenu ZM or its licensors.

Except where expressly permitted, customers may not:

Copy the QuickMenu ZM platform.

Reproduce our software.

Sell or redistribute our platform.

Reverse engineer the Service.

Copy our website design or branding.

Use QuickMenu ZM trademarks without written permission.

Your business content remains your property, subject to the licence described in these Terms.

15. CUSTOMER RESPONSIBILITY FOR BUSINESS OPERATIONS

QuickMenu ZM is a technology and digital-menu service.

The restaurant or business remains solely responsible for:

Food and beverage preparation.

Food quality.

Food safety.

Hygiene.

Pricing.

Stock availability.

Customer service.

Orders.

Payments made directly to the business.

Delivery.

Refunds to restaurant customers.

Compliance with applicable business and food regulations.

QuickMenu ZM does not manufacture, prepare, sell, deliver, or guarantee any food or beverage listed on a customer's menu.

16. LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, QuickMenu ZM will not be responsible for indirect, incidental, special, consequential, or business losses arising from use or inability to use the Service.

This may include loss of:

Revenue.

Profits.

Customers.

Business opportunities.

Data.

Reputation.

QuickMenu ZM will not be responsible for losses caused by inaccurate information supplied by the customer, third-party failures, internet outages, force majeure events, or unauthorized use of customer accounts.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited under applicable law.

17. DATA AND PRIVACY

QuickMenu ZM may collect and process information necessary to provide the Service, including business contact information, account information, menu information, communication records and technical information.

We will use such information for purposes including:

Providing the Service.

Creating and maintaining digital menus.

Communicating with customers.

Providing customer support.

Processing subscriptions and payments.

Maintaining and improving the platform.

Protecting the security of the Service.

Complying with applicable legal obligations.

Personal information will be handled in accordance with our Privacy Policy.

18. SECURITY

We take reasonable technical and organizational measures to protect information and maintain the security of the Service.

However, no internet-based service can be guaranteed to be completely secure.

Customers are responsible for maintaining appropriate security of their own devices, accounts, passwords and business systems.

19. SUSPENSION OR TERMINATION

QuickMenu ZM may suspend or terminate access to the Service where:

Subscription fees remain unpaid.

The customer materially breaches these Terms.

The Service is being used unlawfully.

The customer's activity creates a security risk.

The customer attempts to interfere with the platform.

Continued service would expose QuickMenu ZM to legal or regulatory risk.

Where reasonably possible, QuickMenu ZM may provide notice before suspension or termination.

20. CHANGES TO THE SERVICE

QuickMenu ZM may modify, improve, add or remove features from the Service from time to time.

We may also change subscription plans, pricing or included features.

Where a material change affects an existing paid subscription, we will make reasonable efforts to provide appropriate notice.

21. CHANGES TO THESE TERMS

QuickMenu ZM may update these Terms from time to time.

The latest version will be published on this website together with the applicable effective or updated date.

Your continued use of the Service after updated Terms are published constitutes acceptance of the updated Terms, to the extent permitted by applicable law.

22. GOVERNING LAW

These Terms shall be governed by and interpreted in accordance with the laws of the Republic of Zambia.

Any dispute arising from these Terms or the Service shall, where it cannot be resolved amicably, be subject to the jurisdiction of the appropriate courts of Zambia.

23. DISPUTE RESOLUTION

If you have a complaint or dispute concerning the Service, you should first contact QuickMenu ZM and provide reasonable details of the issue.

We will make reasonable efforts to resolve complaints and disputes amicably before formal legal proceedings are commenced, where appropriate.

24. FORCE MAJEURE

QuickMenu ZM shall not be liable for failure or delay in performing its obligations where such failure or delay results from circumstances beyond its reasonable control.

Such circumstances may include:

Natural disasters.

Floods.

Fire.

Power outages.

Internet outages.

Telecommunications failures.

Government action.

Civil unrest.

Cyberattacks.

Epidemics or pandemics.

Strikes.

Third-party infrastructure failures.

Other events beyond reasonable control.

25. SEVERABILITY

If any provision of these Terms is found to be invalid, illegal or unenforceable, that provision shall be interpreted or modified to the minimum extent necessary, and the remaining provisions shall continue to apply.

26. ENTIRE AGREEMENT

These Terms, together with the Privacy Policy and any applicable subscription agreement or written service agreement, constitute the agreement between QuickMenu ZM and the customer regarding the Service.

Any additional terms agreed in writing between QuickMenu ZM and a customer will prevail over these Terms to the extent of any inconsistency.
